The Province has announced a province-wide emergency and Stay-at-Home Order, with additional restrictions to help control the spread of COVID-19.
Municipalities now have to find ways to give people places to go and things to do that make it possible to get out and get some fresh air and exercise without compromising the rules that are vital: Wear masks – stay six feet away from people you do not know.
Spend your time with immediate family members and don’t be part of groups that are bigger than five people.
Outdoor exercise is considered essential for physical and mental health. Please use caution and follow all public health precautions.
Tyandaga Golf Course
Tyandaga Golf Course is preparing for opening Saturday, April 10, 2021 with COVID-19 safety precautions in place to help keep both golfers and staff safe by minimizing the spread of the virus.
The course is in great shape and combines a perfect mix of urban convenience with rural beauty, natural waterways, contours and mature trees.
Players wishing to book a tee time can now book online at tyandagagolf.com. Booking by phone can be done starting from 9 a.m. to 3 p.m. by calling 905-336-0005.
New Rules and Operations
• Tyandaga will be open daily, 7 days a week, from 6:30 a.m. to close
• Tee times can be booked online through tyandagagolf.com and by phone only, no walk-in green fees
• Only credit card or debit cards will be accepted for payments (no cash)
• Food and beverage services will be limited to window take-out service only. Dining area is closed
• No tournaments at this time
• At this time, Clubhouse will be closed except for washrooms and pro-shop area. Only one guest allowed in pro-shop and washroom at a time
• All power carts are equipped with dividers for player safety. Masks are mandatory to be worn while in the power cart, if not from the same household
• Lessons and rental clubs currently not available
• Practice greens and practice chipping areas are open
• Sand bunker rakes have been removed. Any shots in the bunker are a free drop
• All high-contact surfaces are regularly sanitized such as the payment terminals, all service-related surfaces, power carts and bathrooms
The tee times for the next two weeks are fully booked. The Junior membership has been closed – a flood of new membership applications took up all the spots that were available.
Parks and Trails
City-run parks, playgrounds, skateboard parks, Bocce Ball Court and trails are open. Residents are reminded to stay off all artificial turf fields (that are locked and closed) and to stay six feet away from anyone not in your household. Wearing a mask is also strongly recommended.
Please be courteous to all visitors and help keep the parks clean by taking all your garbage home for proper disposal. Please note most park washrooms are not yet opened for the season, please plan accordingly.
Team sports on fields will be cancelled as there are no permitted activities at this time. Outdoor amenities can be used for casual use.
Participants for community sport and recreation rentals are advised to check in with their organization directly for more information.
We ask that you cooperate with others using outdoor spaces and follow all COVID-19 health precautions and posted signage. If the outdoor recreational space is busy, please try another outdoor recreational amenity in the city or come back at a different time. Please be kind to one another, remain vigilant and stay safe. Through TelePALS, users can participate in free, over-the-phone programs, including Chat Groups, Listen and Learn, Game Shows, Ask the Expert and Listen for Enjoyment.

Recreation Services and Facilities
City of Burlington indoor recreation facilities are closed, and all in-person Spring Session 1 programs are cancelled, including Spring Break Camps and PA Day Camps. Virtual and TelePAL programs will continue as planned. Recreation Services staff are contacting user groups, renters and program participants affected by these changes. An exception applies for user groups who provide childcare, they are able to continue during the emergency brake as per the Provincial Guidelines.
Residents are asked to please be patient during this time as it will take two to four weeks for staff to process the large volume of cancellations.
Those who paid using a credit card will receive a pro-rated refund to their card where possible. This applies to rentals and program participants. All other payment methods will receive a credit to their recreation account.

Play Equipment Lending Library is available with winter-play equipment such as snowshoes, glow in the dark soccer, snow play kit, tug of war, and horseshoes and is intended for use by one family at a time. A list of play equipment is available HERE

• $50 deposit is required at the time of booking
• Play equipment is available for pick-up and drop-off only at the Brant Hills Community Centre, 2255 Brant St.

The outdoor ice at Burlington Rotary Centennial Pond is open. Located at the Waterfront at Downtown Burlington – the rink is open most days from 8:30 a.m. to 10 p.m. and skating is free; however, online, pre-registration is required and can be booked no more than 25-hours in advance.
To accommodate as many community members as possible we ask that they only book one skate per day. The rink is very popular and capacity is reduced for COVID-19 safety. If you cannot come to the rink at your reserved time, please cancel your time so the next group can have an opportunity for fun and activities.

The auto theft scam is back. They go after high end used vehicles.
This one is really dumb – the automotive sector have only themselves to blame for this kind of thing happening.
The Gazette reported on this a number of weeks ago. Do the people in the automotive sector not talk to each other?
The Halton Regional Police Service (HRPS) is asking for the public’s help in identifying a suspect in a recent string of vehicle thefts from dealerships in Oakville and Georgetown.
The police have pictures of a suspect this time.
Police are investigating four similar style thefts with the same suspect involved. The first theft took place on September 8, 2020, and the most recent took place today (September 16) in Oakville (three of the thefts have taken place in Oakville and one in Georgetown).
Typically, the suspect will visit a dealership and state that they would like to purchase a vehicle and request a test drive. Due to COVID-19 policies, on three occasions the suspect has been allowed to test drive the vehicle alone, and leaves the dealership without returning.
On one occasion when the suspect was accompanied on the test drive by an employee, a secondary vehicle became involved and police believe a collision was intentionally initiated. Once the employee exited the vehicle to inspect the damage, both vehicles fled the scene.
Investigation has shown the phone number and identification provided to dealerships to be fraudulent.
All the dealerships targeted sell used Mercedes vehicles.

He is described as male, brown skin, approximately 5’10”, 160 lbs with a thin build, short black hair. He has been seen wearing a white face mask.

If an individual provides you with a contact phone number, call it before they leave the lot to verify that it is valid;

The furniture has been loaded on the moving truck and you are on the way to your new residence.
The men driving the moving truck pull into a gas station – you are following the truck.
They tell you that it is going to take an additional $2000 to complete the job – the movers had already been given a cash deposit.
The customer didn’t like the look or feel on what was taking place and called the police.
Police unloaded the furniture and household items from a van that was suspected of being used in a moving scam. A very grateful citizen.
Halton Regional Police Service (HRPS) officers attended a gas station for what is now being investigated as a moving company scam.
Police officers emptied the moving truck and helped the victim get their possessions to their new home.
A criminal investigation is still ongoing into this occurrence and charges are expected.

• Read your contract prior to signing.

The Mayor and the ward 4 Councilor issued a joint statement this afternoon setting out their take on the LPAT decision to permit the application to build 213 homes on a .90 hectare lot.

Mayor Meed Ward and Councillor Galbraith appeared to want to get their side of the story out, particularly after there were some scathing comments earlier about how some residents felt the Mayor had misled them and that the city’s legal department was less than candid or forthright.

The Local Planning Appeal Tribunal (LPAT) has approved the National Homes 2100 Brant Street development after the local neighbourhood group Vision 2100 Brant withdrew as an opposing party to the hearing. Two residents with participant status at the hearing also withdrew.
In advance of the hearing on July 28, Vision 2100 advised the Tribunal that it had settled with National Homes, with no further changes to the proposed development. Vision 2100 did not present any evidence nor make any submission at the hearing.
Based on the uncontested opinion evidence from planners for National Homes and the City of Burlington in support of a revised proposal, and the submissions of the remaining Parties (including the Region of Halton), the Tribunal issued an oral decision approving the settlement and the proposed planning instruments and plan of subdivision.
The written decision states: “At a Case Management Conference held on June 4, 2020, the Appellant informed the Tribunal that it had reached a settlement agreement with the City and the Regional Municipality of Halton (“Region”). On July 7, 2020, the Vision 2100 Brant Neighbours Association, which was an Added Party, withdrew from the proceedings. On July 8, 2020, Jim Young withdrew as a Participant from the proceedings and on July 15, 2020, Tom Muir withdrew as a Participant from the proceedings. No opposing Parties or Participants remain.”
The property, owned for years by the Catholic church, grew hay.
The LPAT’s approval of the 2100 Brant St. development brings this appeal to a close, except for a ruling from the LPAT on a motion from National Homes for costs for preparing to appear in support of the previous settlement approved by the former city council. In November 2018, the previous city council approved a settlement with National Homes after the municipal election when 5 of the 7 members at the time knew they were not returning, but prior to the new Council being sworn in.
The new Council rescinded that settlement in order to work with residents, the applicant and planning staff to make additional modifications that resulted in further revisions and the settlement the LPAT approved.
The Tribunal also gave authority to the City for final approval for the proposed draft Plan of Subdivision, subject to a long list of conditions from various parties, including:
• dedicating the natural heritage system and neighbourhood park to the City free of charge;
• submitting an On-Street Parking Plan to ensure sufficient area is provided for on-street parking;
• implementing the approved Tree Inventory and Preservation Plans, including cash-in-lieu compensation for removal of any City trees;
• submitting a Landscape Plan that incorporates a two-year post-planting monitoring program to ensure the success of the proposed native plantings;
• providing a cash deposit to be used by the City for contracted or in-house expenses for dealing with non-compliance with City requirements for control of mud, dust and debris removal;
• hiring a contractor on retainer to deal with after-hours problems related to unsafe situations in active subdivisions and provide the City with the contractor’s 24-hour/7-days a week emergency contact phone number; and
• a warning clause on all offers of purchase and sale that the current unsignalized entrance/exit onto Brant Street may be restricted to right in/right out by a centre median, at some point in the future.
A phasing schedule for construction must also be provided identifying proposed house construction (start dates/occupation dates), tentative grading, sodding and tree-planting schedules in accordance with the City’s grading and sodding policy and schedule.

At some point in the future, National Homes will need to obtain site plan approval for the development of the townhouse component of the plan.
Why did the Mayor and the Councillor for the ward feel they had to issue a statement on an LPAT decision?
We will continue to update residents as this application moves into its construction phase.
While this development may not be what some residents or council members were hoping for, it was improved upon multiple times throughout the planning process over what was initially submitted. That was the direct result of the input received from our community.
The revised proposal includes more green space than the original application, including a new park, fewer units, less height and density, more variety and senior-friendly options, increased setbacks and better transition to the neighbourhoods to the north and south.
We thank the public for their involvement in the process and for continually providing their feedback and input.
We would also like to thank the resident group Vision 2100 for their hard work and cooperation in achieving an improved development plan. They spent countless hours and finances over the past few years, working with city staff, council and the developer to make changes to the development that we are sure future residents of this new neighbourhood will appreciate.
In accepting the revised proposal, council considered a number of factors, including public input, the improvements made that addressed some of the concerns raised, the planning justification provided by staff, and advice from legal counsel.
Our decision also factored in some practical realities, including the inability to secure a planning witness that was of the opinion that the November 2018 proposal did not overall represent good planning, the likelihood that a hearing would not produce a different result, and the possibility that city taxpayers could be required to pay the entire costs of the applicant at a lengthy hearing. In addition, city staff who supported the November proposal would likely have been required to testify on behalf of the applicant, at city taxpayers expense.
This application was in its third year of review.
The decision to settle with National Homes on the 2100 Brant development was the responsible decision for all parties involved. We achieved the best plan possible for the community. This development brings townhouse, semi-detached and senior-friendly housing, along with a new neighbourhood park and protection of natural heritage features.

The City of Burlington is offering free packs of disposable masks to assist people in complying with the temporary Mask By-law and to help contain the spread of COVID-19,
Burlington residents who need a mask can come to City Hall or a library branch listed above during operating hours to pick up a mask for themselves or their family.
A staff member located at the entrance doors can direct inquiring residents to take a mask home for use. We recommend that residents follow Public Health Guidelines and wash their re-useable cloth masks before and after use.

We are not likely to see numbers like these in the 2020 financials – linger over them.
Most financial statements use the phrase profit/loss or surplus/deficit. Municipalities are different – they refer to what we know as a surplus as a “positive variance” and what we know as a deficit is a “negative variance”.
Municipalities are not permitted to have a loss – which is why they have reserves; funds they can draw upon when a particular account eats up what the departments had budgeted.
Snow removal is one account that is almost impossible to budget for – the 2014 flood was another example. When they need funds for unexpected events like these – they turn to a reserve fund.
The Tax Stabilization fund is the “piggy bank” that gets tapped frequently. It is also the account that any “surplus” or positive variance gets deposited into.

Jim Young reports on how the Aldershot community is dealing with the COVID 19 crisis.
Those of you who pay attention to what happens in Aldershot, and we know that is everybody in Burlington, have probably heard by now that a group of us out in our city’s wild west are organizing twice weekly food drives to help keep Burlington Foodbank supplied and helping those who need help amid the Covid 19 crisis.
In such times the need for food is greater and in a medical pandemic not only does the need increase but the logistics of supplying foodbanks get more complex and run the risk of food donations drying up completely.
People who might normally donate food are socially and physically distancing themselves, staying home hesitant to venture out of doors. Volunteers who help with collection and distribution of food are less readily available, afraid to expose themselves and families or may even be sick themselves
People are hoarding food and reluctant to share. Hoarding produces a double hit on foodbanks. Fewer personal donations are available and empty store shelves leave grocery chains unable to make the donations of surpluses they regularly provide.
As a result many organizations that provide food for the needy and the hungry, have closed their doors. The lack of donations and the fear of physical contact involved in normal foodbank operations, have forced Halton Compassion Society, like many charitable and church food supply organizations to close down indefinitely.
Faced with a reduction in food donations at a time when the need is greatest, the Outreach Committee at St Matthew Anglican Church, on Plains Rd. are doing something to help. In conjunction with Partnering Aldershot Seniors Committee and Engaged Citizens Ward 1 Group they are collecting non-perishable food donations on behalf of Burlington Foodbank two days per week.
Food donations get dropped off at the front door – out of the weather – they are taken inside moments after they are dropped off.
In an inventive way of collecting donations safely, while limiting personal physical contact, these good folks have established a drive through donation drop off at St. Matthew Anglican Church. This allows donors to continue supporting Burlington’s only operating foodbank safely in this time of crisis and caution.
Supervised from behind the church’s glass frontage, donors drive around the circular driveway, stop by the wooden skids on the sidewalk, get out, safely deposit their donation in bags or boxes and drive off with thanks from the volunteer on duty inside. Donations are accepted Monday and Wednesday from 12.00 noon to 3.00pm.
As 3.00 approaches volunteer drivers arrive one at a time on a pre-arranged schedule to load the donations into their cars. Again “No Contact” is the watchword. Bagged and boxed donations are delivered to Burlington Foodbank on Old Plains Road. At the foodbank wheeled polyethylene laundry hampers await. Drivers transfer the bags from their cars to the carts again with no physical person to person contact involved. Drivers practice safe hygiene protocols for themselves and their vehicles.
Burlington Foodbank has its own quarantine and sanitation protocols in place to ensure that cross contamination of containers and packaging is minimised. Distribution of food hampers will be continued by Burlington Foodbank but will be modified to a delivery model rather than traditional individual pick-ups. Those in need should contact info@burlingtonfoodbank.ca (905 637 CARE (2237).
Our hope is that this process will allow food donations to the foodbank to continue and, as word gets out, to increase from the current extremely reduced levels.
As the only currently safe method of making food donations, Burlington Foodbank is recommending that the Drive-Thru Donations at St Matthew be utilized rather than risky, individual donations at its Old Plains Rd. outlet.
At a time like this, monetary and grocery gift card donations are the most hygienic, non-contact way to donate and we urge people of Burlington to give generously in this way.
For those without the means to donate financially or who may be suffering buyer’s remorse at overstocking during the first days of panic buying, we hope to provide a way to continue giving safely in compliance with physical distancing protocols.

The Directors are named as Orderees because they have management and control of the Company and the Site. Historical Information re: Environmental Compliance Approval# 5131-757NNN In 2007, the Ministry received an application from the engineering firm of Kenneth Youngs Engineering which had been retained by the previous owner of the Site- Frank Moser Investments Incorporated. The engineering firm submitted an application to the Ministry to replace the two existing Class IV septic systems. Both were old clay tile drainage systems which were failing.The Ministry’s engineering assessment report which supports the current ECA, concluded that the holding tank was the only feasible option for the Site as follows:
The Consultant has carried out the design for a replacement sewage works using tertiary treatment and shallow buried trenches and concluded that housed on the type of soil, size of lot, setback requirements for wetland and building/parking requirements, there is not adequate space to construct an on-site sewage disposal system even with tertiary treatment.

This is the only equipment that is documented on the ECA for installation and use at the Site.
Summary of Events
The following provides a summary of the significant events relating to the Site and the ECA.
On August 9, 2011, the Ministry received a letter by Kenneth Youngs Engineering Incorporated signed by an engineer confirming that the 40,000 litre storage tank, alarm system and works had been installed in accordance with their submissions.
On February 9, 2015, the Ministry received a letter from a representative of 1866252 Ontario Limited advising the Ministry that the Company was the new owner of the Site as of August 8, 2014 and requested that the ownership of the ECA be transferred to 1866252 Ontario Limited.
On July 21, 2015, the Ministry forwarded a letter to 1866252 Ontario Limited acknowledging receipt of $10,000 for financial assurance which is required by condition 8 of the ECA.
On May 30, 2016, the Ministry forwarded a letter to 1866252 Ontario Limited acknowledging a change of ownership of the Site from Frank Moser Investments Incorporated to 1866262 Ontario Limited. The Ministry’s letter also provided notification of any environmental approvals which were in effect at the Site and listed Environmental Compliance Approval# 5131-757NNN.
On May 18, 2018, the Ministry received a complaint that employees of Wundeba Restaurant were pumping sewage from a holding tank, onto the ground. The complainant described strong odours and provided photos. It appears from the photographs provided, that employees had pumped septic waste out of the 40,000 litre holding tank and onto the ground.
On May 31, 2018, Provincial Officers Nick Fowler and Carly Munce conducted an inspection of the Site. During the inspection, Officer Fowler was advised by an employee that since purchasing the property, the new owners had re-routed the sewage works. Sewage from the washrooms was now being directed to a septic system and not to the 40,000 litre holding tank. Only sewage generated in the kitchen, was being directed to the holding tank.
On June 13, 2018, Provincial Officer Nick Fowler issued an Onsite Sewage Disposal Site Inspection Report which detailed the Company’s non-compliance with the ECA and required them to enter into a service agreement with a Ministry-approved sewage hauler, by June 22, 2018.
He also requested that the Company decommission the unapproved septic system and reroute the septic system back to the approved, 40,000 holding tank by July 13, 2018. These actions have not been done.
As a result of his inspection, Provincial Officer Nick Fowler issued two Provincial Offences Act notices on the Company. One notice was issued for a depositing waste without an Environmental Compliance Approval, which is a violation of section 40 of the EPA.
The second offence notice was issued for a violation of section 186(3) of the EPA for failure to comply with conditions of the ECA. Specifically, the company failed to provide pumping records which were requested during the May 31, 2018 inspection.
On June 27,2018, I met with Philippe St-Cyr as requested. Mr. St-Cyr stated that they only pump grey water from the kitchen, onto the ground from the holding tank. He agreed that they would cease pumping sewage onto the ground. He also stated that he was not aware of the ECA and that since it was issued to the previous owner it was not applicable to 1866252 Ontario Limited. I stated that the requirements of the ECA are the responsibility of the Company that has care and control of the Site and are in effect at this time. I stated that non-compliance with the conditions of the ECA and pumping sewage out of the septic system and onto the ground were chargeable offences. We discussed the septic systems which were installed at the Site. However it wasn’t clear what equipment had been installed. I requested that an assessment be done of the septic systems at the site. We discussed the possibility of submitting an amendment application to this Ministry requesting approval for the septic system which was in use.
On July 06, 2018, as a follow-up to tour- meeting, I forwarded a letter as an attachment to an email to Mr. St-Cyr. I requested that a service agreement be entered into with a Ministry-approved septic hauler who would regularly inspect and pump out the holding tank as required. This requirement to obtain a service agreement from the hauler is required by condition 5.2 of the ECA. I also requested that a Qualified Person be retained to inspect the system to ensure that it was operating in accordance with the ECA and any unapproved system had been decommissioned by August 09, 2018.
The patio at the rear and the lower level are great places to be on a sunny day. Site is great, food was good when we were last there. Obvious management problems. Unfortunate.
On July 13, 2018, I received an e-mail from Mr. St-Cyr confirming that a Ministry-approved septic waste hauler had been retained to inspect the storage tank bi-weekly and pump it out as required. He disagreed with the purpose of the assessment of the on-site system, which he believed was to assess the functional operation of the system in use and not to assess the environmental compliance of the septic system. He stated that he would like to apply for approval of the septic tank, distribution box and septic bed which is in use at the Site.
On August 07, 2018, 1 received the following report:
Inspection Property: Wundeba Restaurant, 4448 Guelph Line, Burlington, Ontario ESSE Canada, July 31, 2018.
The report assessed the components of an unapproved septic system, which is currently in use at the Site. The components include a septic tank, distribution box and septic bed. It didn’t discuss the 40,000 litre storage tank which is in use, or compliance with the ECA which is in effect for the Site. ·
On August 20, 2018, I mailed a letter to the Company, providing my comments on the July 31, 2018 report. I stated that the approved 40,000 litre holding tank had not been mentioned in the report and the septic system that was described and is in use, has not been approved by the Ministry.
I again requested that the following actions be completed:
1. Retain the services of a Qualified Person to ensure that all sewage from the Site is directed to 40,000 litre holding tank and that the unapproved system is decommissioned. Decommissioning the unapproved septic system would only require that the septic tank be decommissioned and provided a guidance document to decomnssion the septic tank.
2. Provide confirmation that the above acti1ns have been completed. Confirmation was to have been received by October 01, 2018. To date these actions have not been done.
On July 31, 2018, Philippe St-Cyr forwarded an email to me with an amendment to the July 13, 2018 report. The report did discuss the 40;000 litre tank which is installed and in use at the Site.
On September 06, 2018, I received a letter from Mr. St-Cyr. The letter discussed his understanding of what was agreed upon at the June ·27, 2018 meeting at the district office. He believed that the purpose of the assessment was to identify the components of the septic system in use and to determine if they were functioning properly. He also stated that the septic system was in use when the Company purchased the Site and had not been altered. He requested again to submit an amendment application.
On September 12, 2018, I emailed a letter to Mr. St-Cyr. This letter provided an overview of the relevant environmental history of the Site. I also provided a link to the Ministry’s approval applications and guidance documents which are available online.
The letter concluded with the following action item:
Retain the services of a Qualified Person to prepare a report to assess the options to handle the sewage at the Site. The report shall provide recommendations which are in compliance with relevant provincial environmental law and any other regulatory requirements. The report shall include an implementation schedule and a copy forwarded to the undersigned provincial officer by October 17, 2018.
On October 16, 2018, I received an email from Philippe St-Cyr in response to my September 12, 2018 letter which stated that the new owners of the Site, have not re-routed any septic system.
The email concluded with a request to submit an application to amend the current approval. The assessment which I requested in my September 12, 2018 letter, has not been done. On October 31, 2018, the Ministry received a phone call from a resident complaining about strong odours from sewage being pumped out onto the ground at the restaurant.
On November 05, 2018, Provincial Officer Nick Fowler and myself conducted a Site inspection. We noted that the lids on the 40,000 litre tank weren’t secure as required by the ECA. While onsite, we had a brief discussion with Philippe St-Cyr. He again requested to submit an amendment application to approve the septic system that was in use.

After Halton Regional Police Servcices (HPRS) arrested Mohan “Jarry” Ahlowalia for several charges related to human trafficking, his family—the owners of Wundeba—issued a statement claiming the allegations are baseless.
“It is easy and enticing to follow the media and believe everything it says. However, when you and your family are targetted by it, you can really start understanding the meaning of ‘fake news’ and how it can lead you to think a certain way about a situation and can appreciate that what is portrayed in the news is sometimes, and probably more often than not, a fabrication to make their media more exciting,” the statement reads.

It was a decent crowd – even for a meeting that was poorly promoted.
The outcome wasn’t all that clear – what was evident was that the audience didn’t like what they heard and that PERL, Protect the Environment and Rural Lands, the people who fought and won the last battle for Mt Nemo, was not going to lead the charge this time around.
The current Nelson Aggregate holdings: They own the southern portion and have an option on the western portion. The green line is a property boundary; the red line is the extraction boundary.
The operators of the quarry, Nelson Aggregates, had let it be known that they were preparing to make a revised application to mine for aggregate in the southern portion of the site and for the land to the west which is currently Burlington Springs Golf Club.
The Gazette met with the people speaking for the quarry operation and learned much more about the scope and scale of the new plans.
The quarry is owned by Lafarge, Canada’s largest provider of diversified construction materials and a member of the global group, LafargeHolcim. The company has 6,000 employees and 400 sites across Canada.
The operators were taken aback by the 2012 decision to not allow the application to mine on land immediately to the south of the existing quarry. The decision rested on the existence of the Jefferson Salamander that is a threatened species that habitats the area.
It was not an expected decision and resulted in a serious cut back in the number of people employed on the site.
Walt Rickli, raising the belt on a hoist at the studio he once had on the quarry site. They needed the aggregate beneath his building – so he had to move.
Walt Rickli who had a sculpture studio on the land had to find a new home for his heavy equipment – the quarry people needed every square foot of land they could get a back hoe into.
The Nelson quarry people studied the Joint Administrative Review Tribunal (JART) report and worked at how they could resolve the Jefferson Salamander problem and be able to mine the land.
They did their homework and will take their application to the Regional government, City of Burlington and the Niagara Escarpment Commission after which they have to seek a development permit. They will also be seeking a change in the zoning. Three different permits will be required plus a new license from the Ministry of Natural Resources and Forestry.
Mayor Marianne Meed Ward and the Director of Planning has said that before the city even looks at any application they want the decommission work done.
That statement, to some degree, came out of a little bit of ignorance. The license the quarry was given in the 70’s was to mine as much quarry as they wished, or could, on the clearly de-marked site.
The license the quarry has is unlimited, it does not have to be renewed but does require that the land be left as a “lake”.
The critical note attached to the license states:
A note that is part of the license Nelson Aggregates has to mine the property on the #2 Side Road.
Land in the current quarry that has been rehabilitated.
Nelson has already been very proactive in re-rehabilitating the land. When they are finished with one area they begin the rehabilitation. That work is clearly evident when you tour the property which the Gazette did last week.
Before any permit is issued Nelson is fully committed to a dialog with the community. They want to be sure that the residents in the rural area, and those south of Dundas, are fully aware of what the quarry is asking for and offering.
One has to fully understand the quarry’s position. They are in the business of mining and processing some of the best aggregate deposits in the province. They believe they have been good neighbours, which is not a view shared by some.
Rehabilitation of the existing quarry is an ongoing task. The dark brown in the center atop the hill is land fill that has been dumped in to the land.
Residents in the past have complained about the damage done by dynamite blasting. The quarry is required to limit blasting to one day a week at a specific hour. They can only blast on Thursday’s between 12:00 and 1:00 pm. As they prepare to file their applications they will do the now obligatory pre-consultations to ensure that they are complying with all the regulations and learn what they have to provide in the way of studies to ensure that the public interest is being met.

Aggregate is mined daily on the site.
Mining for aggregate is a highly regulated business. The Nelson quarry pumps water out of the site that is some 80 feet below ground level. If those pumps break down they have to immediately advise the Ministry of Natural Resources and Forests and effect repairs as quickly as possible. In order to mine effectively it is vital to keep water out of the site. There are a number of catchment ponds around what is really a huge bowl that has been blasted out of the property from which aggregate has been taken.
Nelson Quarry is proposing that once they have completed the quarrying they will rehabilitate the land and turn title over to the city who will run it as a public park.
The Nelson people are going one further – they are going to create a 15 hectares lake that will have a large sandy beach. The shallow end of the lake (a little like Wasaga Beach where you can walk out for yards before the water comes up to your chest, will become a little deeper and then get quite deep..
In the application they have completed studies that show where the Jefferson Salamander lives and have undertaken to not only not mine that area but to turn it over to the city the day the agreements and zoning bylaws have been set.
The original 2004 application was on property south of #2 Side Road.
The application that will be submitted in the near future will consist of a 60% reduction in proposed extraction area from the previous application.
The revised extraction area will be designed to address the reason the Joint Board refused the previous application (Joint Board Decision 08-030 issued on October 11, 2012).
The area to the right was part of the 2004 application. It will be given to the city the day the agreements to permit quarry work has been signed. The area to the left will be turned into a lake for the public once it has been quarried out – which will be between 7 and 10 years.
In the studies and research they have done the Nelson Quarry people point out that their land holdings meet all the requirements of both the Niagara Escarpment Commission and the Region of Halton.

The recently adopted City of Burlington Official Plan (April 2018) identifies the proposed extraction areas as an “Identified Mineral Resource Area.” The adopted city plan Nelson points to was submitted to the Region and returned to the city because it didn’t comply with the Region’s plan. Burlington is in the process of revising that adopted plan.

The sites are also mapped as a High Potential Mineral Resource Area in the Region of Halton Official Plan.
The existing Burlington Quarry represents Burlington’s only source of construction aggregate within the City.
There are three designations that apply to the land in the NEC plans: natural, protected and rural area. The Nelson properties have the designation that allows for consideration of new Mineral Resource Extraction Areas in the Niagara Escarpment Plan.
In the NEC plan the proposed extraction area is designated Escarpment Rural Area in the Niagara Escarpment Plan.
The appropriateness of this designation and objective was confirmed in the recently approved NEP (2017).
The Nelson Quarry people have done their homework and are returning with an application they feel meets all the shortcomings of the 2004 application that was decided in 2012.
They have significantly reduced the space they will mine on the south side of #2 Side Road and have added the 606 acres that make up the Burlington Springs Golf Course that will give the company enough aggregate to mine for the next 30 years after which it too will be turned over to the public.

Burlington is looking at the potential for a park that will be in the 900 + acres realm – bigger than anything most municipalities across the country have.
Nelson Aggregates will be holding an Open House on the quarry site in October and expects to have their applications in to the three levels of government sometime in November.
