ADI site at Martha and Lakeshore has gone silent since Thanksgiving

A call came in earlier today from a regular reader who lives close to the Martha Street – Lakeshore Road intersection – the site of the ADI Group Nautique development that has people in the area very upset with the noise and disruption.

The ADI Group was advised by the  Home Construction Regulatory Authority (HCRA), that a Notice was being issued that they were subject to a possible license revoction

The caller mentioned that there has been no work done since the Thanksgiving holiday – at that time there were some 30 construction workers hurriedly putting things away.

Since then nothing – which pleases the neighbours.

The following was published on Storeys, a news web site that publishes content about the construction/development industries.

The Home Construction Regulatory Authority (HCRA), confirmed today that ASI is appealing the regulatory action.

In a release dated September 12, Adi, which has operated as a builder in the Greater Toronto Area for 15 years, states an appeal was filed on Thursday, September 8, emphasizing their “disappointment” in what they say has been an abrupt and uncommunicative course of action from the provincial regulator.

“The process undertaken by the HCRA in issuing the Notice has been incredibly disappointing, cursory and arbitrary. Typically, a Regulator is required to exercise their statutory powers with fairness and openness to those under investigation,” said Adi President Tariq Adi, in an emailed statement to STOREYS.

“In our case, we were given no notice of the impending proposal, no understanding of the grounds or documentation for their allegations, and no opportunity to respond or clarify issues before HCRA made the decision to issue a Notice that contained very serious allegations and would have very serious consequences for Adi. Adi Developments’ reputational damage due to this lack of due process and hasty move by the HCRA has been severe.”

In an emailed response to STOREYS, the HCRA stated, “The Home Construction Regulatory Authority is committed to protecting consumers and providing resources to help Ontarians.

The HCRA had made it clear that bad actors in the industry will face severe consequences as a result of the measures introduced by the Ontario government.”

On August 25, the HCRA issued a Notice of Proposal to revoke the building licenses of the nine builder/developer entities operating under the Adi Development Umbrella Group, making an exception for three in-progress developments, including the Nautique, a 26-storey condo located on Burlington’s lakeshore.

Under grounds for the proposal, the HCRA alleges that, after selling units in the Nautique between 2015 – 2020, Adi then sought to cancel existing purchase agreements, citing financing issues. The builder then allegedly failed to return consumer deposits, falsified documentation provided to the HCRA, and demonstrated they were relisting the units for a higher purchase price while refusing to issue deposit refunds until a unit was resold.

As a result, “Adi Development Group has demonstrated, through the conduct of its related entities and interested persons, that its corporations should not be licenced builders or vendors under the NHCLA,” states the regulator’s filing.

Revocation or refusal to renew a licence are the most severe consequences for a builder/vendor. Revoking a licence prevents a developer from legally operating in the new home construction sector. Should a builder continue to illegally operate without a licence, the regulator can take additional enforcement steps such as

Compliance Orders;
Restraining Orders;
Freeze Orders; and
Provincial Offences Act charges

In a statement regarding their appeal, Adi refutes the allegations. “The suggestion that Adi acted unethically or that it provided incomplete or false information to the HCRA as part of this process is ludicrous as well as defamatory,” states the release.

They go on to say the HCRA’s proposal was actually spurred by steps taken by the builder to “ensure the ongoing success and completion of their 26-storey condominium Lakeshore project,” citing increased project costs due to the pandemic and “inflationary pressures”. According to Adi, the cost to build has ballooned to $43M, a 35% increase from the original budget.

“Adi was forced to seek additional financing and to cancel purchase agreements in order to secure the new financing,” states the release.

Adi says it consulted with the HCRA in regards to the situation, and that cancelled purchase agreements were done so lawfully and within the contractual terms and regulations set out by Tarion, as they gave purchasers “alternative options.” The builder refutes the allegations made by the HCRA that original purchasers who agreed to forfeit their purchase would only receive a deposit refund once the unit had been resold and a new deposit obtained.

“At no point did Adi tie the return of deposits to the resale of the units, as HCRA alleged. It shocked Adi that this proposal was the path taken by HCRA in respect of the Lakeshore development without prior notice or discussion and that it included eight other unrelated projects within the Adi group of companies in the regulatory net,” reads their release.

As well, writes the builder, “In a demonstration of good faith and in order to mitigate the impact on purchasers,” it offered former purchasers who were not interested in a new purchase agreement an additional 6% interest on their deposits. Adi also says that for the “majority of purchase agreement holders who did wish to move forward,” they were offered to repurchase their units at 20% below market prices, and were also given $10,000 in “décor dollars” as an incentive.

The builder says they have been working with Lakeshore purchasers on their deposit returns, including interest, claiming that as of September 7, 85% have been returned, totalling more than $9M.

“We have cooperated fully with the HCRA up to this point and remain willing and hopeful that despite the appeal we can reach an expedited resolution on all issues with the HCRA so that we can complete the Lakeshore and other projects,” states Tariq. “Many builders out there require guidance from HCRA in order to get through this, not to have their licences pulled. We feel we have been unfairly singled out.”

Adi’s case will now go to the Licence Appeal Tribunal (LAT) for a case conference to reach a resolution, with a hearing to be held if one isn’t reached. If the LAT decision upholds the HCRA’s decision and the licensee does not appeal the decision in Division Court, then the licence is revoked.

A Deeper Look at the Legal Mess the Adi Development Group is Struggling With.

Earlier today we published a short piece on the decision HRCA (Home Construction Regulatory Authority) made regarding the public filing made to the attention of Tariq Adi, Daniela Tom, calling for the revocation of building licences of six of the umbrella group’s nine entities for violations under the New Home Construction Licencing Act (NHCLA).

The regulator is also proposing amendments to the licences for the remaining three  Adi Developments (Lakeshore) Inc., Adi Developments (Thomas Alton) Inc., and 4880 Valera Road — to allow them to complete ongoing development projects to “avoid putting purchasers at further risk by cancelling these projects mid-construction.”

The ongoing projects in question are The Nautique Lakefront Residences located at 364 Martha Street, Realm Condominiums at 4853 Thomas Altona Boulevard, and The Valera, at 4880 Valera Road, all in Burlington.

“Adi Development Group has demonstrated, through the conduct of its related entities and interested persons, that its corporations should not be licenced builders or vendors under the NHCLA,” states the filing.

Bob Aaron, real estate lawyer at Aaron & Aaron Barristers and Solicitors, tells STOREYS that this is the first such act of enforcement made by the HCRA since its formation as a standalone regulator outside of Tarion in 2021. The inability of Adi to obtain an HCRA licence (formerly a Tarion Registration) essentially shuts them down, barring their ability to vend or build any new projects.

“Anybody who sells new construction without being licenced can be fined, and in fact, there have been cases where unlicensed builders have gone to jail for exactly that thing, selling unlicensed properties,” he says.

“If they try to sell new projects they will not have a Tarion licence and that will be disclosed in the agreements of purchase and sale, and nobody’s going to buy it if there’s no Tarion warranty.”

The HCRA specifically points to the Nautique development, which it opened an investigation into after receiving numerous consumer complaints.

The condo development, which sold units between 2010 – 2015, gained notoriety after Adi notified 174 purchasers on March 23, 2022, that their agreements would be terminated due to the builder’s “failure to obtain satisfactory construction financing.”

However, as the regulator notes, despite making this claim, Adi didn’t cancel all purchase agreements — just those without a high enough sale price. The developer then sought to resell the units at substantially higher prices, the HCRA states.

Three months later, on June 20, 2022, the HCRA found Adi had only issued 27 purchasers their deposit refunds. The builder also confirmed at that time that they would only issue a refund to an original purchaser once a unit had been resold, and a new deposit received.

“Adi Morgan Developments (Lakeshore) Inc. has cancelled hundreds of purchase and sale agreements for condominium units in order to increase its profits. It expects purchasers under an existing agreement to pay hundreds of thousands of dollars more for their units. For those who are unwilling to do so, Adi Morgan Developments (Lakeshore) Inc. will only return deposits once a new purchaser comes along who is prepared to pay the increased price,” states the filing.

The HCRA adds that in response to a request for sale agreement documentation, Adi provided falsified versions, with altered dates and termination clauses.

“Not only is this unethical, and a violation of both the NHCLA and the Ontario New Home Warranties Plan Act (ONHWPA) but it also raises concerns about Adi Morgan Developments (Lakeshore) Inc.’s financial responsibility and competency.”

An advisory distributed by the HCRA on August 19, outlines the code builders must adhere to in regards to price escalations and contract terminations, stating that licencees must honour their agreements.

“If the Addendum and Agreement do not include a specific additional charge, payment, or anticipated adjustment, or if such a clause is not clear or is potentially misleading, the HCRA expects licencees to honour the original purchase price and complete the Agreement unless the purchaser consents by amendment to the Agreement to price adjustments/additional charges,” states the advisory.

“Depending on the circumstances, the HCRA may consider a licencee’s attempt to amend the Agreement to increase the purchase price as an indicator that a licencee has not demonstrated the necessary competencies to possess a licence including financial competency.”

These factors can include the amount of the requested price increase, the reason, the stage of construction, and the number of impacted purchasers, as well as how soon the project is to its closing date.

Aaron says that while he commends the HCRA and the government for their “proactive stance”, he’s curious as to how much this enforcement pertains to the price increase hitting consumers, or the other unethical behaviour Adi has allegedly engaged in.

“I wonder how much of these proceeding relates to them not refunding deposits versus increasing the prices without justification. So we will have to see whether HCRA is going to pursue other builders who may be returning deposits, but have increased the prices without justification,” he says.

“If we find another builder who does not falsify documents, who has refunded the deposits, but who has just made enormous price increases, one wonders whether the HCRA will peruse those builders just for increasing the prices — that remains to be seen.”

Adi Development Group has the option to appeal and request a hearing before the License Appeal Tribunal, and must deliver notice of appeal within 15 calendar days. If no action is taken, their licence is to be revoked as of Friday, September 9.

Home renovation fraud - Regional Police aware and looking for information.

When there is a change in the way business is done the thieves in the world will find a way to exploit the change and take advantage of people who are not fully aware of the change.

Try hiring a trades person. They just aren’t available. What happens – Home Renovation Fraud takes place.

The Halton Regional Police Service (HRPS) is issuing a warning to residents about a home repair fraud believed to be operating in the region.
Police believe these suspects may be intentionally targeting older adults.

The fraud involves contractors travelling door-to-door selling services that are unsolicited by a consumer. The suspect will provide quotes with prices lower than market value and once a deal is reached, will request a large cash payment. Based on complaints, initial work may start, however the work will be sub-par and/or incomplete.

After this initial work, the consumer may be approached to provide more money for supplies or to complete payment for the project. Once this additional or final payment is received, the contractor disappears and phone calls and text messages will go unanswered leaving the consumer with a damaged or partially completed project.

If in doubt DON’T And ask questions

There have been two complaints with this similar mode of operation and suspects in Halton. Police believe there may be additional victims in Halton, as well as outside of our region.

The suspects are described as two white males with Irish or possibly Scottish accents.

Suspect 1 is 25-35 years old, approximately 5’9” – 6’0” tall with a heavy build and dark black hair.

Suspect 2 is also 25-35 years old approximately 5’9” – 6’0” tall with a heavy build and short light blonde or light brown hair. This suspect was also wearing a moustache.

In both cases the suspects had a younger man with them claiming to be a son of one of the suspects.

Anyone with information regarding this investigation is asked to contact the Regional Fraud Unit at 905-465-8741.

Prices for detached single family houses have soared during the past year.  Homes have sold for 49% above the asking.

The folks in the condo market are now experiencing the same problem – with the difference being that  people who paid deposits are now finding the price of the condo they have yet to take possession of has gone up

Construction delays and price increases, according to the developers, are the problem in the condo world theses days.

The Gallery, a 26 storey tower currently under construction across the street from city hall is behind schedule.

Folks who have purchased in the Carnicelli Gallery going up opposite city hall have been told that it will be something in the order of eight to ten months more before they can call the moving van.  They had expected to move in sometime in November

A couple of blocks to the west people who have purchased in the Nautique have been told that the original deal isn’t on anymore,.

The ADI Group development determined that construction costs make it impossible for them to build at the original selling price.

The Nautique has been plagued with problems from the day they filed their application to build. Readers of the Gazette have followed this amazing story.

People who had sales agreements will have their money returned and be paid interest on the deposit or they can pony up an additional 50 to 60% and wait until the building is ready for occupancy.

One Gazette reader said there was a weasel clause in the sales contract that let ADI take the action they took.

ADI has access to exceptional legal talent – buyers are going to have to retain smart talent of their own.  The lawyer on the client side should have seen the clause in the agreement and advised their client as to what was possible.

Glenn Gillespie, an about to retire fire fighter expected be in the unit be bought in 2015.

Gillespie said he had a choice: either pay the extra money for a condo that doesn’t exist yet or get his $126,000 deposit back with 6 percent interest and give up his unit.

Keenleyside reports on state of affairs at Freeman Station

A Report to All FOFS Directors and Members at Large
We’ve been closed for a variety of reasons: normal winter shut down; Covid-19 restrictions and accumulation of snow effectively eliminating parking at Freeman station. In spite of this a few projects continue to move along, and a couple of new projects have begun.

First of all, re: the restoration of the caboose… Before the cold and the snow closed down operations Ken Brooks and his dedicated team of experts replaced the windows in the cupola after reattaching it to the main frame. Simultaneously the station’s electrical system is being
extended to the rolling stock and ultimately to the three shipping containers at the back of the property. In preparation for next spring, tongue & groove lumber is being stockpiled in the station half has already been primed and painted and the remainder is being prepared as we speak.

Meanwhile inside our long-awaited video wall, which acts as a backdrop for the diorama, is nearing completion. Following closely behind, will be the installation of an a/v link from the basement to the waiting room to provide a visual connection for those people unable to use
the stairs. Both of these projects are being completed thanks to the generosity of the Ontario Trillium Foundation.

This is what they started out with – Sitting on some “cribbing” with a sign badly in need of several coats of paint, the Freeman Station gets ready for its big move.

Now that we have completed the restoration of the station (in record time, I might add) it is time to look at an important component of the station that needs updating. That is our website. We have struggled to find a person who has the time and knowledge to manage this
valuable communication and fundraising tool. Over the years items have been added which had a temporary importance but which were never removed. One of the most common comments is that our website could be more user friendly. Well, work is now underway to
remedy that concern. The original company in St. Catharines has been contacted about resurrecting the site. With the pandemic lock-down, there are no visitors and thus virtually no donations. Therefore the sooner the website is fixed so that it encourages donations and
makes it super easy to donate, the better.

Settled in the new home – the task now was to complete the refurbishing and make it a destination for railways buffs.

On the fundraising side of our corporation, I am proud to tell you that due to your generosity, we had a successful campaign this fall. As they say on PBS “THANK YOU!” In addition, I have recently received good news from the federal government. Our application for a $10,000 grant has been approved and those funds will be soon deposited in our account. Being a 100% volunteer organization, we depend heavily on visitors for most of our donations. Since we have virtually been closed for two years, that has put quite a strain on our bottom line.

Another new project is just getting started, and this is a review of our By-Laws. Last October 2021 the Ontario Not-For-Profit Act was enacted. All corporations, like ours, must ensure their by-laws conform to these new regulations. Thankfully, all corporations have been allowed time to make any necessary adjustments.

One more aspect of our heritage train station is to complete an accurate inventory of all items we own. Since we are a small museum, we are unable to store unused items, and we have only limited space to display other items. This has led to the establishment of a Collections Policy and a Collections Committee. This group is headed up by the hard-working Dave Ellis.

Currently they have spread out a large number of tools and other items at the station. Some of these will go into the eventual FOFS workshop in one of the three containers at the back of the property. Other items that are not needed will be sold or disposed of. The remaining items will then be properly identified and added to a comprehensive FOFS inventory.

The year 2022 also marks another milestone in the FOFS history. At the end of the year our land-use agreement with the Solenis Chemical Company will expire.

Contact has already been made with their manager in order to facilitate an extension of that contract. We are fortunate to be a partner with the city and Solenis in maintaining and operating this valuable heritage site for future generations. With the City of Burlington owning the building and Solenis owning the land we are indeed in good hands.

The pandemic has been a real challenge to your Board of Directors as well as the community we serve. The immediate future is uncertain from a health and safety point of view. We have been very careful with Covid restrictions, and so far, it has paid off. We will continue to make your health and safety our number one priority.

Please continue to support this wonderful architectural gem that has undergone a miraculous transformation in a few short years. From a utilitarian train station built in 1906 for less than $2,000, it has cost many times that amount to bring this historic piece of Freeman and
Burlington history back to life.

Greater Toronto and Hamilton Area Sees Big Investment in Culture and Recreation Projects

Recently, the government has committed to investing around $5.2 million in three culture and recreation projects in Central Ontario and the Greater Toronto and Hamilton Area (GTHA).

The impact of Covid stretches far beyond our health and hospitals. All areas of the local community have been affected by lockdowns, and families, businesses and communities across the country have had to make big changes to their way of lives. As a result of this disruption, the Canadian and Ontario governments are working together to support people and communities by ensuring that local infrastructure is safe and reliable. At the same time, the government is also looking ahead to see what else can be done in these unprecedented times.

Recently, Sven Spengemann, member of parliament for Mississauga—Lakeshore, announced a series of joint funding. This funding will be specifically for three culture and recreation infrastructure projects in the GTHA and Central Ontario. This announcement was made on behalf of the Minister of Infrastructure and Communities as well as Ontario’s Minister of Small Business and Red Tape Reduction. The move will see businesses receive some bonus funding for Covid support, but as Bonusfinder Canada explains, there can be restrictions to watch out for.

Who is Paying for These Projects?
The Government of Canada will be spending approximately $2.8 million on these projects under the Investing in Canada Infrastructure Program’s Community, Culture, and Recreation Infrastructure Stream. The Ontario government alone will also be funding more than $2.3 million to these initiatives, while beneficiaries are investing a total of more than $1.9 million in their own projects.

Under the Community, Culture, and Recreation Infrastructure Stream of the Investing in Canada Infrastructure Program, Ontario will contribute roughly $320 million over the next ten years, while Canada will invest around $407 million.

What Is the Money Being Spent On?
This announcement comes after a wave of infrastructure spending is planned for the country in the wake of the Covid pandemic. The government is hoping that with increased spending, communities will be able to return to normal much faster once restrictions have been lifted. This funding will aim to support the building of new facilities and upgrades to existing facilities. All of the projects focus on improving community infrastructure and also include recreational venues and cultural spaces such as museums, theatres and more.

Upgrades to trail infrastructure in conservation areas in Caledon, Erin, Halton Hills, and Mississauga are among the projects that have been financed. They will improve public access to local greenspaces by better connecting trails with neighbouring towns and removing barriers. Trail improvements include the repair of four pedestrian bridges, the construction of three new pedestrian bridges, the expansion of paths by 2.8 kilometres, and the repair of 3.1 kilometres of boardwalk.

The Lincoln Museum and Cultural Centre will also receive funding for the design, manufacturing, and installation of an indoor and outdoor children’s gallery, which will provide families with educational content to learn more about local history and culture. Upgrades to the Unionville Seniors Hub’s Community Centre in Markham will provide new programmes and services to meet the special requirements of seniors and their caregivers. These initiatives, once completed, will provide citizens with better access to recreation facilities for many years to come.

Spengemann had the following to say about the funding “Ensuring residents have access to quality recreation infrastructure is vital for community well-being and development. Today’s investment for three culture and recreation infrastructure projects in the GTHA and Central Ontario will provide residents with access to modern, reliable, and even more accessible recreation facilities”.
