BURLINGTON, ON

Too little, too late.

That piece of equipment will take that tree down in minutes.

The City is aware of the cutting down of trees on those portions of the Millcroft Golf Course that have been approved for redevelopment by the Ontario Land Tribunal.

The City is investigating this activity and as such, no further comment can be provided at this time.

The City recognizes that many in our community have an interest in this project. The City will keep the community informed as much as possible as the project proceeds.

The city will find that the developer is, in all probability, following the instructions were issued by the Ontario Land Tribunal.

Any complaint should be made to the Tribunal.

The OLT was implemented to override municipal concerns about intrusive development.

A permit designating which trees may be felled would still be required to meet the requirements of the Private Tree Bylaw, would it not?

Editor’s note: What isn’t clear is does a Tribunal decision over ride a municipal bylaw?

Editor. Take that a step further. The OLT has ruled that the developer may develop the lands. Does that ruling by the OLT mean the developer does not need to get a City issued development permit of any sort? I am sure the independent self-appointed City watchdogs that comment on Gazette articles must have that answer.

Editor’s note: I will put the question to the City Solicitor and the Commissioner responsible for development.

I would ave liked to have heard the the Mayor say something a little more emphatic and assure citizens that the city will do everything it can to assure that the developer adheres to the city’s bylaws.
