The Burlington Aquatic Devilrays (BAD) said they needed 50 hours of pool time every week when they filed their RFP (Request for Proposal the City issued.
 “It is new pool time we negotiated,” said Calderbank.
Kimberly Calderbank, volunteer president of the Devilrays said at the time that her club could get by with 40 hours.
They have 35 hours, which means some programs might have to be dropped.
Registration is taking place and by the end of the week, Calderbank and the team she works with, will have figured out what they are going to be able to do this season and accept what they have to work with for the next four years.
What BAD has been able to do is get time at the Ron Edwards Family YMCA pool, a “game changer” from Calderbank’s perspective. “It is new pool time we negotiated,” said Calderbank.
GHAC – the Golden Horseshoe Aquatic Club has time at every city swimming pool while BAD has time at: Nelson, Centennial, and Angela Coughlan.
GHAC got additional swimming pool time as a result of the RFP they won, through what many people think was a flawed process.
What everyone is waiting for is what does each club have in the way of members registered for the fall programs.
 Is the 80% Burlington resident requirement still in place? And what if GHAC membership does not meet the 80% Burlington residential requirement?
I don’t think this story is over yet.
What the Gazette would like to see if a fair, independent look at what really happened during the determination of who won the RFP.
The fear many have is that the city will try to sweep everything under the rug.

The Burlington Aquatic Devilrays (BAD) announced a bold new chapter in the club’s history: a partnership with the Ron Edwards Family YMCA in Burlington that will expand access to aquatic training, support local athletes, and deepen our impact in the community.
As part of the City of Burlington’s recent pool allocation process, BAD has secured 18 hours of pool time per week at City facilities for a four-year term beginning in the 2025 season.

City Hall announced minutes ago that a solution for competitive youth swimming has been reached between the City, the Golden Horseshoe Aquatic Club (GHAC) and the Burlington Aquatic Devilrays (BAD).
With the best interests of all youth swimmers and their families in mind, the City worked closely with both GHAC and BAD to determine each club’s pool needs. Both clubs recognized and agreed to streamline their contemplated offerings and seek programming in private pool facilities to ensure that both organizations can offer competitive youth swimming options for residents of Burlington within the number of hours in City pools that have been set aside for that purpose.
 The City recognizes the collaborative efforts of GHAC, the successful bidder in the RFP process, and BAD in reaching agreements with the City that balance their operational needs with the recognition that both clubs will provide valuable programming in City pools now and in the years to come.
Youth swimming plays a vital role in fostering healthy, active lifestyles and building strong community connections. Through swimming partners like GHAC and BAD, young people develop physical fitness, confidence, and discipline – skills that benefit them both in and out of the water. These programs also create inclusive spaces where youth can socialize, learn teamwork, and grow in a supportive environment. These are qualities that are important to the future of the City, and we are pleased to support them with partners like GHAC and BAD.

The Courts have rendered a decision on the behaviour of the five hockey players.
The academics don’t see it all quite the same way.
Brock university experts weigh in on trial of former Hockey Canada players
While the sexual assault trial involving five former Hockey Canada players concluded with a not guilty verdict, the case will have far-reaching implications for the hockey community and wider society, say Brock University experts.
“While the verdict marked the end of the legal proceedings, the case itself reignited widespread scrutiny of hockey’s institutional values and the environments that elite players are socialized into,” says Assistant Professor of Sport Management Taylor McKee. “The outcome of the trial does not erase the cultural concerns that were brought to the surface, particularly around power, accountability and silence within hockey’s most protected spaces.”
McKee says an instinctive response for Hockey Canada would be to examine ways of “fixing” the problem by implementing training programs or other measures to prevent future sexual violence committed by hockey players.
But the actions of the players in question, including text messages they sent to each other discussing what to say to investigators about the night’s events, suggest they knew what they did was wrong, he says.
“There’s no seminar on the books in the world that is going to fix attitudes towards young women that these guys clearly had,” says McKee.
Hockey Canada, he says, instead needs to hold the whole team accountable for the actions of its players. This could be through sanctions, for example, which include team suspensions and collective punishment doled out by teams and Hockey Canada.
On a broader societal level, the case also highlights issues surrounding victim testimony and court procedures.
While Criminologist Voula Marinos also says the verdict shouldn’t negate issues concerning sexual violence and power imbalances within and outside of sport, there are explicit legal requirements to be met when trying a charge of sexual assault.
Marinos says the burden of proof is on the Crown, rather than the defence, to prove that the complainant, E.M., consented to the sexual acts.
“When it comes to the criminal process, it is about the evidence presented that leads to a legal determination based upon legal standards,” says Marinos. “It may be very difficult to remember that it is about evidence that is available and entered into a case.”
Marinos also notes that Ontario Superior Court Justice Maria Carroccia, who tried the case, said while not all inconsistencies in a testimony mean a witness is lying, there was “cause for concern” about whether E.M.’s evidence was credible or reliable.
“Importantly, the judge stated that subjective and lived experiences may not objectively be the truth as the judge looked at a constellation of all of the evidence,” says Marinos. “The Crown did not meet its high criminal standard of proving the charges beyond a reasonable doubt.”
Forensic Psychologist Angela Book says E.M.’s testimony reflects a number of behaviours related to people’s reactions in dangerous situations.
Self-silencing, for instance, is “not speaking one’s thoughts due to wanting to maintain harmony among others,” says the Professor of Psychology, while “judgmental self-doubt” involves distrusting one’s perception of a situation.
“We think those two tendencies, when combined, lead to capitulation, which is defined as the tendency to ignore, dismiss or downplay warning signs of danger and remain in a potentially dangerous situation,” she says.
Book is concluding research she conducted with Lakehead University Associate Professor Beth Visser (along with PhD students Theresia Bedard and Veronika Fendler-Janssen) on “self-silencing,” “judgmental self-doubt” and how they relate to reactions in dangerous situations.
She says early gender socialization has taught many women to suppress negative statements or fears to be nice, polite, compliant and not “rock the boat.”
There is also the “freeze” psychological and physiological response where a victim appears passive out of fear or avoiding further harm when in a traumatic situation, Book says.
Judging how a victim acts during a sexual assault can be misleading, she says, given these and other trauma responses.
It will be interesting to see what Hockey Canada decides to do in the months ahead. The National Hockey League has already said the hockey players cannot return to the ice until the NHL has completed its review

We learned earlier today that there is a Golden Horseshoe Aquatic Club (GHAC) member lurking around the BAD swimmers when they are on the swimming pool deck and actively trying to persuade them to join the GHAC – and that he can take care of all the details.
That is foul. The swimmers are going through enough exasperation.
It gets worse. An individual sent a comment to the Gazette on the Valeria Latkovic story we published. As Publisher, I am legally liable for what we publish. While I personally know many of the people who send in a comments – there are new people every day.

Then there is Caleb – that’s the name a writer uses. He is really a foul individual. He capacity is limited to negative comments. There are three comments in the queue- they won’t be published.
What happened to the concept of sportsmanship.?

A reader reported to us that he called one of the “older” Councillors, asking what he the Councillor thought about how the issue would be resolved. “We have to let the two clubs work it out”.
Leadership?
One more bit of news. The Competitive Swimming Club had a difference of opinion with the city a number of years ago and sued – and, according to our source, they won the Court and were awarded a sum of money.
There is a lot about how swimming pool space has been allocated in the past that is not as public as it should be. Something is seriously wrong somewhere in the administration.

My name is Valeria, I’m a BAD senior competitive swimmer, and a Burlington resident. I started swimming with BAD when I was 6 years old and I’m now almost 15. I have spent more than half of my life swimming with the club that has become my family. I have trained thousands of hours, attended dozens of meets, attended international training camp, volunteered in the community over the last 9 years I have been with the club. The skills I acquired with BAD also allowed me to represent my Burlington high school. I trained with all the BAD coaches who have become important mentors in my life. My younger brother has been swimming with BAD for the last 3 years as well.
I attended the Council meeting on July 7th to support my club. My swim mate delegated at this meet. Mayor Meed Ward asked him what his options were at this point given that my club stands to close. It made me think and discuss this with my parents. So here are my options:
Go to GHAC. First, I don’t want to join the club whose Leadership is trying to break up my family. Also, GHAC senior swimmers train outside of Burlington in the McMaster pool facilities which is difficult for me to get to since my parents both work and cannot drive me. This situation created a rivalry between the clubs and I don’t think I will be welcomed there.
Go to OAK. Oak hasn’t responded to my application for trials. Although I qualified for provincial times, OAK is down one pool next year and they don’t have any more space. Also, OAK’s fees are almost double compared to what my parents pay at BAD, a significant hurdle for our family.
Go to Milton. In order for me to be able to join the team, I will have to change schools so that I can make it to practices. I don’t want to lose more friends. Also, it would be very challenging for my parents to drive me there to attend the practices.
It is the end of July and I don’t have a plan. I don’t know if I will be able to swim at all next year and it breaks my heart. I don’t understand why very capable adults cannot figure this out and prioritize the Burlington children in our community.

Focus Burlington, using data provided by Jim Thomson, who delegated at City Council earlier this week, published a piece from which we have excerpted the important stuff.
EXCERPT
“The City of Burlington issued two RFPs in 2025 related to renting pool time. The two RFPs were issued a little over a month apart. The same city staff member handled both RPFS, but the treatment of the groups that responded to the RFPs was very different.
RFP-25-203 “Competitive Adult Swimming – Program Provider” – March 14, 2025
Summary “the allotted amount of pool time (375 hours/year) that must be purchased from the City for the expressed purpose of delivering the Adult Swimming Programs as contemplated in this Request for Proposals.”
Cost: 375 hours at $134.00 per hour or $50,250 a year.
Overview: A swim club charges members a fee for coaching services and pool time. The club uses part of the fee to pay the City of Burlington $50,250 a year for pool time.
RFP-25-202 “Competitive Youth Swimming – Program Provider” – April 17, 2025
Summary “the allotted amount of pool time (2000 hours/year) that must be purchased from the City for the expressed purpose of delivering the Youth Competitive and Development Swimming Programs as contemplated in this Request for Proposals.”
Cost: 2,000 hours at $110.00 per hour or $220,000 a year.

“Looking at the details of the RFP for the adult program, two groups submitted proposals GHAC and the Burlington Masters Swim Club.
“One of these two groups asked a question through the formal RFP process:
 If this information is true – then the city has to suspend the award given to GHAC and agree with BAD that a Judicial Review is now necessary.

“Is there another layer to this disqualification?
“Is this why Councillor Kearns has called for an external audit of the process?”

The City of Burlington is committed to engaging the Burlington Aquatic Devilrays (BAD) and the Golden Horseshoe Aquatic Club (GHAC) in finding a path forward that supports all Burlington youth swimmers.
 “As we have heard over the past few weeks, recent discussions about the future of youth swimming have been difficult for many in our community. However, what has become clear over this time is that high quality competitive swim programming is a treasured aspect of life in Burlington – and one that our residents feel strongly about.
“At the City, we are also mindful of our responsibility to provide strong services and good value to taxpayers. We are committed to working closely with GHAC and BAD toward a balanced solution – one that meets the needs of athletes and families while making effective use of public facilities and resources.
“In the coming days, we will engage in open and constructive dialogue with both clubs, focusing on collaboration, fairness, and the best interests of Burlington’s youth.
“We look forward to sharing the results of this effort with the community in the near future and thank City Council for their support of this work.”

How to Work out Your Hand Value
